Common neighbour disputes and how to handle them

Living harmoniously with your neighbours can occasionally be difficult and neighbour disputes can arise which may result in a feud of epic proportions.

Neighbour disputes can end up affecting everyone in the neighbourhood, not just the feuding parties.  It is therefore sensible to attempt to resolve any issues quickly and as amicably as possible as everyone has the right to live in a peaceful neighbourhood.

Two common disputes relate to dividing fences and overhanging trees.  Both of these issues are governed by the Neighbourhood Disputes (Dividing Fences and Trees) Act 2011.

If you are experiencing either of these issues, you may find it useful to know that the Queensland Government Dispute Resolution Centres offer a free, confidential mediation service to help you manage your neighbour disputes without going to court, which can end up being a costly exercise.   The mediator will act as an impartial third party to guide you through a structured mediation process, however it must be remembered that in order for mediation to be successful, both sides must be willing to participate.
